LOCAL BANDHAN – Terms & Conditions

Local Bandhan Private Limited, the parent company hereafter named as ‘Local Bandhan’ or ‘the Company’ or ‘We’ as may be required by the context, provides a personalized subscription service that allows our members to access videos, podcasts and other visual content streamed over the Internet to certain Internet-connected TVs, computers and smartphones. (“Local Bandhan content”)

These Terms of Use govern your use of our service. As used in these Terms of Use, “Local Bandhan service”, “Our Service” or “the Service” means the personalized service provided by Local Bandhan Private Limited for discovering and watching the content, including all features and functionalities, recommendations and reviews, the website, and user interfaces, as well as all content and software associated with our service.

 

AGREEMENT ACCEPTANCE: You accept this Agreement by clicking on 'Sign Up' button where you are given the option to do so while creating an account with us, either for use, specific paid one and/or free, or for subscription. If you do not accept the terms of this Agreement, you may and cannot use the Program. By accepting this Agreement, you confirm that you are at least 18 years old (or the age of majority where you reside, whichever is older) and that you are able to enter into and execute a legally binding contract under the relevant laws of the land. If you are accepting this Agreement on behalf of a company or other legal entity, you represent and warrant that you have the legal authority to bind that company or legal entity, as the case may be, by the terms of this Agreement.

 

ACCOUNT SETUP AND MAINTENANCE: You must ensure that all the information you provide in connection with establishing your Program account is true and accurate while providing the same and you must keep it up-to-date as long as you intend to use and also while using the Program. You may maintain only one account at a time unless you are using multiple accounts solely for the purpose of Delivery Materials or making multiple subscriptions available via independent Local Bandhan Subscription Access through integration and otherwise. You would not use false identities and / or would not impersonate any other person or use a username or password you are not authorized to use. You authorize us, directly or through third parties, to make any inquiries as deemed appropriate by us to verify the account information you provide. You also consent to sending us your emails relating to the Program and other publishing opportunities from time to time. You are solely responsible for safeguarding and maintaining the confidentiality of your account's username and password and are responsible for all activities which may occur under and from your account, whether or not you have authorized said activities. You may not permit any third party to use the Program, through and under your account and would not use the account of any third party. You explicitly agree to immediately notify Local Bandhan of any unauthorized use of your username, password or account, as the case may be.

 

TENURE : This Agreement commences upon your acceptance of it and continues in perpetuity until terminated as set forth in this Agreement. All rights granted to Local Bandhan herein would not be deemed to have been lapsed at any time in accordance with the applicable laws of the Territory, including but not limited to for the avoidance of doubt, the provisions of Section 19(4) read with Section 30-A of the Indian Copyright Act, 1957, as applicable. We may terminate this Agreement by issuance of notice to you at any time. You may terminate this Agreement at any time by issuance of notice of termination to us, in which event we would cease offering your subscribed services, within thirty (30) days from the date that we receive notice of termination; provided that if you distribute the services via independent Local Bandhan Subscription Access through integration and otherwise, (a) the Term of the Agreement with respect to independent Local Bandhan Subscription Access would commence upon your acceptance of this Agreement and continue for the period which you have opted for at the time of payments as and by of consideration payable to us for the services rendered to you from the date that your Subscription begins on the Service (the ' Initial Subscription Term') and (b) the Initial Subscription Term would not automatically extend for any period save and except unless the subscription opted for allows for automated renewal depending on the territory.

 

 

 

 

 

Promotional Offers

We may from time to time offer special promotional offers, plans or memberships (“Offers”). Offer eligibility is determined by Local Bandhan at its sole discretion and we reserve the right to revoke an offer and put your account on hold in the event that we determine you are not eligible. Members of households with an existing or recent Local Bandhan membership may not be eligible for certain introductory offers. We may use information such as device ID, method of payment or an account email address used with an existing or recent Local Bandhan membership to determine Offer eligibility. The eligibility requirements and other limitations and conditions will be disclosed when you sign-up for the Offer or in other communications made available to you.

 

 

 

 

Billing and Cancellation

1. Billing Cycle. The length of your billing cycle will depend on the type of subscription that you choose when you signed up for the service. Your service will start from the date of successful receipt of payment by us. You can check your subscription details from App or website from My Profile section.

2. Payment Methods. To use the Local Bandhan service you can buy suitable subscription plans using RazorPay payment gateway. On Apple platforms, you can use in-App purchase mechanism in addition to RazorPay gateway. The supported payment methods are Credit Card, UPI and Net Banking.

. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.

3. Updating your Payment Methods: Local Bandhan does not store your payment methods such as credit card details or cvv. Therefore, you will need to provide payment information everytime you transact with Local Bandhan.

 

 

4. Cancellation. You continue to have access to the Local Bandhan service through the end of your billing period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial membership periods or unwatched Local Bandhan content. To see when your account will close, click “Subscription Details” on the “My Account” page. If you signed up for Local Bandhan using your account with a third party as a Payment Method and wish to cancel your Local Bandhan membership, you may need to do so through such third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the Local Bandhan service through that third party.

 

 

 

Local Bandhan Service

1. You must be at least 18 years of age  to become a member of the Local Bandhan service. Minors may only use the service under the supervision of an adult.

2. The Local Bandhan service and any content viewed through the service are for your personal and non-commercial use only and may not be shared with individuals beyond your household. During your Local Bandhan membership we grant you a limited, non-exclusive, non-transferable right to access the Local Bandhan service and view Local Bandhan content. Except for the foregoing, no right, title or interest shall be transferred to you. You agree not to use the service for public performances.

3. You may view the Local Bandhan content primarily within the country in which you have established your account and only in geographic locations where we offer our service and have licensed such content. The content that may be available to watch will vary by geographic location and will change from time to time. The number of devices on which you may simultaneously watch depends on your chosen subscription plan and is specified on the “My Account” page.

4.  The Local Bandhan service, including the content library, is regularly updated. In addition, we continually test various aspects of our service, including our website, user interfaces, promotional features and availability of Local Bandhan content.

6. You agree to use the Local Bandhan service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained on or obtained from or through the Local Bandhan service. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the Local Bandhan service; use any robot, spider, scraper or other automated means to access the Local Bandhan service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the Local Bandhan service; insert any code or product or manipulate the content of the Local Bandhan service in any way; or use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Local Bandhan service, including any software viruses or any other computer code, files or programs. We may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.

 7. The quality of the display of the Local Bandhan content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. HD, Ultra HD and HDR availability is subject to your Internet service and device capabilities. Not all content is available in all formats, such as HD, Ultra HD or HDR and not all subscription plans allow you to receive content in all formats. Default playback settings on cellular networks exclude HD, Ultra HD and HDR content. The minimum connection speed for SD quality is 1.0 Mbps; however, we recommend a faster connection for improved video quality. A download speed of at least 3.0 Mbps per stream is recommended to receive HD content (defined as a resolution of 720p or higher). A download speed of at least 15.0  Mbps per stream is recommended to receive Ultra HD (defined as a resolution of 4K or higher). You are responsible for all Internet access charges. Please check with your Internet provider for information on possible Internet data usage charges. The time it takes to begin watching Local Bandhan content will vary based on a number of factors, including your location, available bandwidth at the time, the content you have selected and the configuration of your Local Bandhan ready device.

8.Local Bandhan software is developed by, or for, Local Bandhan and may solely be used for authorized streaming and viewing of Local Bandhan content through Local Bandhan ready devices. This software may vary by device and medium, and functionalities and features may also differ between devices. You acknowledge that the use of the service may require third party software that is subject to third party licenses. You agree that you may automatically receive updated versions of the Local Bandhan software and related third-party software.

 

 

 

Passwords and Account Access

 The member who created the Local Bandhan account and whose Payment Method is charged (the “Account Owner”) is responsible for any activity that occurs through the Local Bandhan account. To maintain control over the account and to prevent anyone from accessing the account (which would include information on viewing history for the account), the Account Owner should maintain control over the Local Bandhan ready devices that are used to access the service and not reveal the password or details of the Payment Method associated with the account to anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We can terminate your account or place your account on hold in order to protect you, Local Bandhan or our partners from identity theft or other fraudulent activity.

 

 

Warranties and Limitations on Liability

The Local Bandhan service is provided “as is” and without warranty or condition. In particular, our service may not be uninterrupted or error-free. You waive all special, indirect and consequential damages against us. These terms will not limit any non-waivable warranties or mandatory consumer protection rights that apply to you.

 

 

 

Miscellaneous

1. Governing Law. These Terms of Use shall be governed by and construed in accordance with the laws of India.

2. Unsolicited Materials. Local Bandhan does not accept unsolicited materials or ideas for Local Bandhan content and is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to Local Bandhan.

3. Customer Support. To find more information about our service and its features or if you need assistance with your account, please write to info@localbandhan.com.

4.  Survival. If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.

5. Changes to Terms of Use and Assignment. Local Bandhan may, from time to time, change these Terms of Use. We will notify you at least 30 days before such changes apply to you. We may assign or transfer our agreement with you including our associated rights and obligations at any time and you agree to cooperate with us in connection with such an assignment or transfer.

6. Electronic Communications. We will send you information relating to your account (e.g. payment authorizations, invoices, Payment Method, confirmation messages, notices) in electronic form only, for example via emails or sms to your email address or phone number respectively provided during your registration.

We do not store your credit card and / or debit card number and / or expiry date of credit card and / or debit card and / or other details pertaining to your credit card and / or debit card on Program Site or anywhere else. Credit card and / or debit card information may be collected and processed by our online payment partner, viz Razorpay.

Information you post: We collect information you post in a public space on our website and / or on a third-party social media site belonging to and / or being operated by Local Bandhan Pvt. Ltd.

WE COLLECT INFORMATION IN DIFFERENT WAYS:

We collect information directly from you: We collect information directly from you when you register and / or subscribe for an event from our website. We also collect information if you post a comment on our websites or ask us a question through phone or email.

Refund Policy

 

 

As is clearly stated in the Terms of Use, Local Bandhan is not liable to refund any monies paid towards the subscriptions (also referred as memberships), the subscription services, the extent of available Subscription Digital Content, and the specific titles available through subscription services.

users who are situated in India, the recurring subscription option is not available and, as such, the subscription and / or membership of Local Bandhan Platform would automatically come to an end / expired as soon as the term for which the existing subscription and / or membership expires. In either cases, Local Bandhan would not be liable to refund any monies paid to it by the user for the existing subscription and / or membership.

Furthermore, when the user is availing the free access, Local Bandhan would check that the credit card being used by the user is valid and has a sufficient amount so that the user can pay for the subscription.
